DOCOMO Pacific, Inc. Net Neutrality Disclosure Statement

  1. Introduction

    DOCOMO PACIFIC is committed to providing all of its customers with the best online experience possible. DOCOMO PACIFIC does not inhibit the ability of its customers to access the Internet through its wireless broadband services. DOCOMO PACIFIC permits the use of its broadband services for browsing the Internet via DOCOMO PACIFIC phones or devices, using email, downloading legally permissible content via the Internet, accessing and using corporate email and/or corporate business applications associated with its customers' places of employment. DOCOMO PACIFIC allows its customers to choose from several rate plans with different maximum upload and download speeds to meet their individual needs. Customers wishing to download audio and video clips from the internet may access video streaming on any of our 3G data plans.

  2. General Network Management Practices

    Like all Internet service providers, DOCOMO PACIFIC needs to manage its network and uses reasonable network management practices consistent with industry standards and the FCC's Open Internet rules. This is to ensure the reliability of its network is maintained and to minimize network issues. Accordingly, DOCOMO PACIFIC retains the right to restrict the use of broadband services under, but not limited to, the following circumstances: to prohibit or inhibit access to the establishment of a server or other hosting device or application(s); to prohibit or inhibit the continuous downloading or uploading of files such as (but not limited to) broadcasts, movies, videos, images, games and music; to prohibit or inhibit excessive or continuous broadband connections; and/or, to prohibit or inhibit abusive or inappropriate content and/or solicitation; to prohibit the unauthorized use or distribution of material subject to a third party's actual or claimed intellectual property rights or any action. The foregoing are based on the sole judgment, decision and discretion of DOCOMO PACIFIC when and if DOCOMO PACIFIC makes the determination that such Internet use is causing or will cause damage, interference with the broadband network, other broadband networks or others' use of the broadband network(s). These practices are protocol-agnostic to the content itself and to the websites that provide it.

  3. Network Security

    DOCOMO PACIFIC provides a firewall only for email services. The firewall blocks viruses but not other security threats such as malware. For mobile data services, and for email service that is not provided by DOCOMO PACIFIC, customers are responsible for obtaining third-party security applications.

  4. Specialized services (e.g., VoIP and Internet Protocol-video)

    Currently, DOCOMO PACIFIC does not offer these services. Customers can use such services by way of application on smartphone and PC applications. Effects on other customers are slow data speed due to network congestion. DOCOMO PACIFIC expressly reserves the right to modify, block and/or charge for applications which negatively affect other customers.

  5. Broadband Speed and Benchmark Testing

    Our mobile broadband 3G users can expect typical data speeds of 100kbps-1Mbps for uploads, and 500Kbps to 8Mbps for downloads. Mobile broadband devices can experience peak speeds of up to 21Mbps downloads and 1.4Mbps for uploads. DOCOMO PACIFIC measures its network performance utilizing the following performance measurements and methodology:

    1. Operation and Support System (OSS)
      1. Performance Management function enables us to monitor Key Performance Indicators (KPI) such as Call Setup Success Rate, Retainability, Cell Throughput, HSDPA accessibility.
    2. Drive test and Indoor test
      1. These tools enable us to measure signal level, Interference, throughput, signaling, etc.
    3. Speed test
      1. Periodical throughput measurement using speed test web site.

DOCOMO PACIFIC believes this approach provides the best approximation of actual speeds and latency for its service.

Customers can verify data speeds using a web-based application available on DOCOMO PACIFIC'S website at http://speedtest.docomopacific.net/. Customers can also use a variety of testing applications available on third-party websites, such as www.broadband.gov/qualitytest/about/ (as of November 20, 2011), to measure the provisional speeds of DOCOMO PACIFIC's broadband service. Such third-party websites are not affiliated with DOCOMO PACIFIC and the company does make any guarantees as to the accuracy of test results obtained through those third-parties.

DOCOMO PACIFIC does not restrict the types of devices that connect customers to its network, nor does DOCOMO PACIFIC restrict third-party applications.
